Welcome to Novels Haven ("we," "our," or "us"). By accessing or using our website novelshaven.com, related applications, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Copyright/DMCA Policy

We respect intellectual property rights and respond to notices of alleged infringement that comply with applicable law (including 17 U.S.C. § 512 where applicable). To report infringement, contact us at contact@novelshaven.com including: (i) identification of the copyrighted work; (ii) identification of the material claimed to be infringing and its location on the Service; (iii) your contact information; (iv) a statement of good‑faith belief that the use is not authorized; (v) a statement under penalty of perjury that the notice is accurate and you are authorized to act; and (vi) a physical or electronic signature. We may remove content and, for repeat infringement, terminate accounts. For more details, see our DMCA Policy.

3. Eligibility

You must be at least thirteen (13) years old, or the minimum legal age of consent in your jurisdiction, to access or use the Service. By using the Service, you represent and warrant that you meet this requirement; that you have not previously been suspended or removed from the Service; and that your registration for and use of the Service complies with all applicable laws. If you are using the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.

4. Account Registration & Security

You agree to provide accurate, complete, and current information when creating an account and to maintain and promptly update such information. You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any suspected unauthorized use or security breach.

5. Payments & Chapter Keys

We sell a premium in-service digital currency called Chapter Keys. Chapter Keys may be purchased using one-time, non-recurring payments in U.S. Dollars (USD) via a third-party payment processor. We do not collect or store full payment card details. Your use of the processor's services is governed by their own terms and privacy policy, which we encourage you to review.

Nature of Chapter Keys. Chapter Keys are a limited, revocable, non-transferable, non-exclusive license to access paid features and premium content within the Service. Chapter Keys have no cash or monetary value, are not legal tender, and cannot be redeemed for cash or any other consideration. Chapter Keys may only be used within the Service and do not constitute a stored-value instrument.

Deduction & Irreversibility. When you spend Chapter Keys to unlock content (e.g., chapters), the applicable amount is immediately deducted and will not be reversed, even if you later delete your account or content becomes unavailable, except where required by law.

Refunds. All purchases are final and non-refundable, except in cases where (i) a verified technical error in our systems prevented delivery of Chapter Keys or access to purchased content, or (ii) you were charged in error due to our mistake. In such cases, contact support@novelshaven.com. Where appropriate, we may restore access, correct the error, or issue a full refund. No partial refunds will be granted. Nothing in this section affects rights that cannot be waived under applicable law. If you are located in a jurisdiction that grants statutory withdrawal or cooling-off rights for immediately delivered digital content, you acknowledge that access begins immediately upon payment and you expressly consent to the immediate performance and waive such rights to the maximum extent permitted by law.

Negative Balances & Chargebacks. If your Chapter Keys balance becomes negative, you agree to promptly pay the outstanding amount upon demand. Filing a payment dispute or chargeback without first contacting us may result in account limitations or termination.

6. Refund Policy (Summary)

This policy applies to purchases of digital currency (keys/credits). All purchases are final and non-refundable, subject only to the limited exceptions above. Please review orders carefully before checkout. Contact us first to resolve billing or technical issues before initiating a dispute with your payment provider.

7. User Content & Acceptable Use

You are responsible for any content you submit or display on the Service. You represent and warrant that you have all necessary rights to your content and that your content does not infringe the rights of any third party. By posting content, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, perform, and prepare derivative works of such content in connection with operating and promoting the Service.

You agree not to submit content that is unlawful; infringes copyright, trademark, or other rights; contains hate speech, defamation, or sexually explicit material; or otherwise violates these Terms or applicable law. You may not interfere with the security or operation of the Service; attempt to circumvent access controls or paywalls; or use bots, scrapers, or similar tools without our prior written permission. Unauthorized commercial exploitation of the Service is prohibited.

8. Third-Party Services & Links

We integrate with certain third-party services essential to the Service, including payment processing by a third-party processor and analytics provided by Google Analytics. Your data may be processed by such third parties in accordance with their own terms and privacy policies. We encourage you to review those policies directly. We do not control and are not responsible for the availability or performance of third-party services.

The Service may display third-party content or links. We are not responsible for such content or for any products or services offered by third parties. Your interactions with third-party content are solely between you and the applicable third party.

9. Service Availability & Modifications

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. Access may be suspended or restricted without notice for maintenance, upgrades, or events beyond our control. We may modify, suspend, or discontinue any part of the Service at any time.

10. Termination

We may suspend or terminate your account or access to the Service at any time for any reason, with or without notice, including for violations of these Terms or applicable law. You may request deletion of your account by emailing contact@novelshaven.com. Account deletion requests are subject to a seven (7) day grace period, during which the account is inactive but recoverable. After this period, your account and personal data will be permanently deleted to the extent required by law, subject to limited retention for legal, regulatory, security, or recordkeeping purposes. Upon termination, unused Chapter Keys are forfeited and no refunds are provided, except where required by law.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Limitation of Liability

To the fullest extent permitted by law, in no event shall Novels Haven or its affiliates be liable for any indirect, consequential, incidental, special, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service. Our aggregate liability to you for all claims shall not exceed the greater of one hundred U.S. dollars (USD $100) or the total amount you paid to us during the twelve (12) months immediately preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Novels Haven and its affiliates, and their respective officers, directors, employees, agents, and contractors, from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service; your violation of these Terms or of law; or your infringement of any third-party rights.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration on an individual basis, rather than in court, except that you may assert individual claims in small-claims court if they qualify. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. Arbitration shall be conducted by a single arbitrator and administered pursuant to applicable rules. Unless prohibited by law, arbitration shall take place in California.

Before initiating arbitration, you agree to first provide written notice of the dispute to contact@novelshaven.com and allow thirty (30) days to attempt informal resolution. Any cause of action or claim must be commenced within one (1) year after it accrues. If any portion of this arbitration provision is found unenforceable, that portion shall be severed and the remainder enforced to the fullest extent permitted by law.

15. Changes to These Terms

We may revise these Terms from time to time. When changes are made, we will update the "Last updated" date above and may provide additional notice where required. Unless otherwise required by law, revised Terms take effect upon posting. Your continued access or use of the Service after posting constitutes acceptance of the changes. If you do not agree to the revised Terms, discontinue use of the Service.
